DEFINITIONS IN THESE TERMS AND CONDITIONS
The “we”, “our”, “us” and “ourselves” means Kayak-King and any associated staff.
The “customer” means any person, parent, firm, company or other legal entity which places an order or buys any products or services from Kayak-king and includes the employee’s servants, agents or sub-contractors of any such person, firm company or other legal entity.
The “tour” means the Kayaking activity session carried out by Kayak-King.
A Booking will be made when Kayak-King acknowledges acceptance of the customer’s payment.
Full payment is required to reserve your space on a tour at the time of booking.
Payment can be made by debit/credit card.
Any payments confirm acceptance of Kayak-King’s Terms and Conditions.
CHANGES BY THE CUSTOMER
If you find it necessary to change your tour details, please let us know as soon as possible. Kayak-King is not responsible for any group number changes. Any changes in group numbers made to a confirmed booking by the customer can only be made by prior arrangement. When possible we will always accommodate customer changes.
Any price increase incurred through customer changes must be paid in full at the time of change. No refund will be given if the price is lower than the original agreed price.
CANCELLATION BY THE CUSTOMER
All bookings are final: No-shows be that individuals/groups in part or whole, for any reason including illness or infirmity, will receive zero refund.
Customers will also receive a full refund or credit in case of operator cancellation due to weather or other unforeseen circumstances.
In the event of cancellation by the customer and/or associated members of their party, not attending the agreed tour, kayak-King does not issue refunds or offer alternative dates. We highly recommend that all guests purchase trip cancellation and interruption insurance.
CANCELLATIONS BY KAYAK-KING
Kayak-King reserves the right to cancel any tour prior to departure for any reason whatsoever, including insufficient bookings, political instability, terrorism or logistical problems that may impede tour operations. If we have to cancel a tour you may choose between alternate tour dates or if not acceptable by the customer, we refund full payment.
Kayak-King is not responsible for expenses incurred by trip participants in preparing for a cancelled trip (for example non-refundable advance purchase plane tickets, visa fees, inoculations, equipment etc. or for any additional arrangements for other travel plans associated with this tour.)
Kayak-King will make every reasonable effort to contact you as soon as it appears that a trip may be cancelled.
Because of the sheltered nature of our venue, almost all tours run regardless of weather conditions. If a tour is cancelled due to adverse weather conditions making it unsuitable or unsafe for the customers then alternate dates or a credit note to the full value of the cancelled services will be offered to the customer.
Although no previous kayaking experience is required on our tours, as with any sport there is always an element of risk. While our trips are not considered to be strenuous or physically demanding, and we do not require a high level of fitness, a good general physical condition is necessary. If you have any physical limitations or concerns please let us know. As we are not qualified to evaluate your level of fitness we ask that you (possibly along with your doctor) determine whether or not you are able to join one of our tours. If you have any special medical conditions, we encourage you to check with your doctor before you reserve your trip. Please also note that all of our tours take place in remote areas and evacuations can take a great deal of time and can be expensive. Persons with various disabilities are welcome on Kayak-King tours, pending a discussion of any special needs and requirements.
Kayak-King is dedicated to providing safe, environmentally sensitive, well-organized, fun-filled tours of the coast. For the customer’s safety and that of the rest of the group, you agree to accept the authority of the Kayak-King guides at all times. You need to be aware that group needs may involve compromise to accommodate the diverse desires and abilities of group members. We just ask that you welcome your tour with an open mind and be able to laugh and have fun when/if encountering the unexpected.
If the customer fails to comply with the instructions/advice of the Kayak-King guides, we reserve the right to exclude the customer from the tour or refuse carriage of the customer at any time and do not accept any responsibility for any liability, loss expense or damages arising because of the customer’s failure to comply. Any monies paid by the customer are not returnable.
We do not accept any responsibility of any kind for the customer’s property of any description, including monies, luggage and vehicle. Property is in all circumstances the sole responsibility of the customer. Kayak-King takes no responsibility for customers keys and any other property stored in the Kayak-King vehicles while on our tour, such items are left at the customer’s own risk.
SUPERVISION OF MINORS
We will be responsible for tour instruction only. Adults accompanying a group of children are in loco-parentis and are responsible for the safety and well being of those children at all times. The customers in charge of the children are responsible for their behaviour. Behaviour that disrupts the smooth running of a tour may result in the disruptive customer(s) being excluded and being refused carriage. We do not accept any responsibility for any liability, loss expense or damages arising because of the customer’s behaviour. Any monies paid by the customer are not returnable. Any damage caused to property or equipment as a result of unruly behaviour will be charged for.
Group leaders who accompany a group of minors will be responsible for the adequate supervision of all group members outside of tour time.
AGGRESSIVE OR OFFENSIVE BEHAVIOUR BY THE CUSTOMER
Behaviour that disrupts the smooth running of a tour may result in the disruptive customer(s) being excluded and being refused carriage. We do not accept any responsibility for any liability, loss expense or damages arising because of the customer’s behaviour. Any monies paid by the customer are not returnable.
Any damage caused to property or equipment as a result of unruly behaviour will be charged for.
ALCOHOL AND DRUGS
Customers must not be under the influence of alcohol or drugs while on a Kayak-King tour. We reserve the right to exclude the customer from any tour provided by ourselves if we feel the customer is unfit to participate in the tour. Any monies paid by the customer are not returnable.
CHANGES IN ADVERTISED PRICE
The prices advertised by Kayak-King are valid at the time of publication. Any changes will be made clear when the customer makes their booking.
Vouchers are usually valid for 12 months from the date of purchase (unless otherwise stated) and shall become invalid on the expiry date. The expiry date is set out in the Voucher. Vouchers may be extended for a further 12 months on payment of an administration fee of £20 (plus any increase that may have taken place for that activity since the original date of purchase). Please note that Vouchers cannot be extended once they have expired and extensions can only take place once.
The recipient is free to book their preferred date within the Voucher validity period. Kayak-King tours are subject to availability and may be subject to weather conditions. To avoid disappointment we recommend that customers book well in advance, at least 6-8 weeks for the majority of experiences. During peak periods it may be necessary to allow a longer notice period although Kayak-King will occasionally be able to fit in a booking at short notice. We recommend booking as early as possible as you must have undertaken your experience before the expiry date printed on the front of your Voucher. We strongly advise that you do not make any travel, accommodation or other arrangements until you have received confirmation of your booking. Once a date has been booked your Voucher will be deemed to be used at that point.
Gift vouchers are paid for in full at the time of purchase and last for one year from the purchase date. Gift vouchers cannot be redeemed for cash value.
INSURANCE AND LIABILITY
We hold public liability insurance up to £5 million and are happy to provide a copy of our certificate should you need one. Bookings with Kayak-King DO NOT include personal travel or accident insurance. Please ask your insurer for details of the necessary cover for taking part in Sea Kayaking.
KAYAK-KING TOUR EQUIPMENT
Kayak-King maintains a high quality of equipment and takes all reasonable measures to ensure equipment is in a safe, usable condition. Any damage to the equipment while in the customers care should be reported to a member of our staff.
Kayak-King reserves the right to take photographic or film records of any of its tours. Customers should be aware that we may use these photos or film for promotional and or commercial purposes without remuneration to the tour customers.
Copyright and all other intellectual property rights in the products and services shown in Kayak-King’s price lists, brochures and other literature shall remain at all time the property of Kayak-King. The customer shall acquire no rights in the products and services except as expressly provided for in these terms and conditions.
STORAGE OF PERSONAL AND FINANCIAL INFORMATION
Due to the nature of our services, it is necessary to collect and store a certain amount of personal and financial information. By providing us with address, personal and financial information, you consent to the storage of this information for a period of time deemed appropriate by Kayak-King. Personal information includes, but is not limited to, your first name, last name, phone number, email address and billing address. Financial information includes, but is not limited to, your card account number, card expiration date and cardholder name.
We will NEVER sell, rent, lease or otherwise trade your information with any third party company, other than as may be required by law. Note however that communications over the internet are open to interception and we make no guarantees that information will not be intercepted by third parties.

MEDICAL AND RISK ACKNOWLEDGEMENT/ LIABILITY RELEASE FORMS
Each participant is required to fully fill out the medical form and liability release form prior to tour departure.
We are open and able to take bookings. We have a full refund guarantee for bookings that have to be cancelled due to the COVID-19 Government guidelines.
Gratuities are always appreciated. If you feel the guides have done an exceptional job, tipping is a great way to show your appreciation. We also appreciate other expressions of thanks including cards, letters etc.
